1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Fantera mobile application, the Fantera website, and related services (the “Service”), operated by Fantera, Inc. (“Fantera,” “we,” “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
2. Eligibility
You may use the Service only if you:
- are at least 13 years of age. If you are under 18, you represent that a parent or legal guardian is aware of and consents to your use of the Service and agrees to these Terms on your behalf;
- are a resident of the United States;
- are not on any U.S. government sanctions or prohibited-parties list and are not located in a comprehensively sanctioned region; and
- have the legal capacity to enter into these Terms.
The Service is not directed to children under 13. We collect and check your date of birth when you create an account, and accounts for anyone under 13 are not permitted. See the Children’s Privacy section of our Privacy Policy.
3. Your Account
To use the Service you create an account and verify your phone number or email with a one-time passcode. You agree to provide accurate information, keep your account secure, and are responsible for activity under your account. Notify us at support@fantera.net if you suspect unauthorized use. 4. The Service
Fantera is a fan engagement platform for college athletics. Through the Service you can earn Fan Reward Tokens (“FNR”) by attending games, completing challenges, making predictions, participating in the community feed, and taking other qualifying actions; progress through an engagement tier program (Bronze, Silver, Gold, Platinum, and MVP); and, where and when Fantera makes rewards available, redeem FNR for rewards offered within the Service. Some features described in the Service may not be available in all versions, in all locations, or at all times, and Fantera may add, change, or remove features at any time with fair notice of material changes to FNR earning or redemption.
The Service uses the Ovatra blockchain as an audit and transparency layer for certain events (such as consent records and FNR issuance). You do not need to understand or interact with the blockchain to use the Service.
5. FNR — Nature and Limitations
FNR is a closed-loop reward point issued by Fantera for fan engagement. FNR is not a cryptocurrency, security, investment, commodity, currency, medium of exchange, stored value, or financial instrument of any kind. FNR has no cash value, is not redeemable for cash or fiat currency, is non-transferable between users, and cannot be traded on any secondary market or withdrawn from the platform. The Service uses the Ovatra blockchain only to keep an auditable record of FNR issuance and redemption; tracking FNR on a blockchain does not change its nature as a closed-loop reward point.
FNR is awarded to you as a participant in a promotional rewards program, under a revocable license. It is not your property in any sense that allows transfer, sale, inheritance, or conversion to cash. Fantera makes no representation that FNR has or will retain any value, and may modify earning rates, redemption rates, or the reward catalog at any time with fair notice of material changes. Nothing about FNR is an offer or sale of securities.
6. Earning and Redeeming FNR
You earn FNR by taking qualifying actions defined within the Service, such as attending a game, completing a challenge, making a correct prediction, or participating in the community. Specific rates, caps, multipliers, and anti-abuse controls are published within the Service and may change. Where Fantera makes redemption available, FNR may be redeemed for the items listed in the Service at the rates shown at the time of redemption; redeemed FNR is permanently burned and cannot be returned to your balance. Fantera may refuse to credit, or may claw back, FNR earned through fraud, abuse, error, or violation of these Terms.
7. FNR Expiration and Seasonal Reset
FNR expires at the start of each athletic season. On the first day of each new season (August 1, subject to change), every fan’s FNR balance is reset to zero. Any FNR earned but not redeemed before the reset is permanently expired and cannot be restored. Your FNR balance does not carry over from one season to the next. You are responsible for redeeming FNR before the reset, and Fantera will provide reasonable advance notice through in-app messages in the weeks beforehand. Expired FNR has no cash value and its expiration is not recoverable as damages.
8. Tier Program
The Service operates a five-tier program (Bronze, Silver, Gold, Platinum, MVP). Tier progression is based on FNR earned during the current season and other engagement criteria. At each seasonal reset, your tier returns to Bronze, your seasonal progression returns to zero, and your FNR balance is expired to zero, all together. Your lifetime FNR earned and history are preserved for recognition and analytics but do not carry to the new season.
As described in our Privacy Policy, certain tier-progression benefits are linked to participation in “Partner Sharing” consent. Fans who turn Partner Sharing off continue to earn FNR at the base rate and keep any tier already achieved; only future tier progression pauses while it is off. Fantera believes this reflects the relationship between fan-data contribution and the value that funds the rewards program, consistent with California Civil Code § 1798.125(b).
9. Community Feed and Content Rules
The Service includes a community feed and crew (group) features where you can post, react, vote in polls, submit game predictions, and interact with other fans. Your use of these features is governed by these Terms, the Privacy Policy, and the standards below.
9.1 Predictions
You may submit predictions on eligible games. Submissions lock at game start and pay a published amount of FNR for a correct pick (presently 20 FNR). Prediction submission is free: you do not stake, spend, or risk FNR or anything of value to participate, no cash prize is offered, and FNR awarded for correct predictions has no cash value. The prediction feature is provided for entertainment and does not constitute wagering, betting, or a gambling service. Fantera may suspend the feature for anyone who attempts to manipulate it.
9.2 Content Standards
You agree not to submit content to the Service that:
- threatens violence or harm against any person, group, or institution;
- harasses, bullies, or targets any person, including student-athletes, coaches, staff, other fans, or Fantera personnel;
- contains slurs or content reasonably understood as hate speech;
- is sexually explicit, or sexualizes any identifiable person without consent;
- discloses another person’s private information without consent;
- infringes anyone’s intellectual property, publicity, or privacy rights;
- impersonates another person, program, brand, or Fantera;
- promotes illegal activity;
- attempts to evade moderation, manipulate the feed ranking, prediction, flagging, or FNR systems, or is generated by automated means and misrepresented as human; or
- violates any applicable law or these Terms.
9.3 Moderation, Strikes, and Appeals
Fantera moderates content using a combination of automated classification (including services from OpenAI and Google’s Perspective API), community reporting, and human review. Automated classification may block a post before it publishes, hold it for review, or flag a published post for review. You consent to this processing of your content as a condition of submitting it.
Depending on severity, a violation may result in a warning, a strike (strikes expire after 90 days), a temporary posting cooldown, a posting restriction (you may still react, vote, and predict but not create new content), account suspension, or termination. Severe violations may result in immediate restriction or ban. If you believe a decision was made in error, you may appeal it through the Service; appeals are reviewed by a human, and a successful appeal reverses the action and any associated strike.
9.4 Reporting and Blocking
You can report an abusive user, and block them, from their profile (the “…” menu), and you can report a message in a crew chat by pressing and holding it. Blocking a person hides their content from you and prevents contact between you. You can also email support@fantera.net to report content or a user. See our Support page.
9.5 Your License to Fantera
You retain ownership of the content you create. By submitting content to the Service (including posts, polls, predictions, replies, reactions, photos, and profile information), you grant Fantera a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, adapt, publish, distribute, and display that content to operate and improve the Service, including in aggregated and de-identified form. This license continues for content already shared with third parties or included in an aggregated dataset before you deleted it, as described in the Privacy Policy. You represent that you have the rights to grant this license and that your content does not violate the law or anyone’s rights. Fantera operates the Service consistent with the protections of Section 230 of the Communications Decency Act.
10. Prohibited Activities
In addition to the content rules above, you agree not to:
- use the Service in violation of any law or these Terms;
- create more than one account, or an account using another person’s identity;
- earn or attempt to earn FNR by fraudulent, automated, or deceptive means, including fake check-ins, bots, scripts, or emulators;
- exploit bugs to obtain unearned FNR or rewards;
- reverse-engineer the Service except where that restriction is prohibited by law, or access it through automated means without our permission;
- scrape or harvest data from the Service, or interfere with its security or operation;
- transfer, sell, or trade FNR to or from another user (FNR is non-transferable); or
- create replacement accounts to evade a restriction or ban.
Violations may result in suspension or termination, clawback of FNR, forfeiture of rewards, and, where appropriate, referral to law enforcement.
11. Termination
You may delete your account at any time from Profile → Data Rights in the app; see our Account Deletionpage. FNR held at deletion is forfeited. Fantera may suspend or terminate your account, with or without notice, for violation of these Terms, suspected fraud or abuse, legal requirement, prolonged inactivity, discontinuation of the Service, or other reasons consistent with applicable law. Provisions that by their nature should survive termination (including Sections 5, 10, 12–19) survive.
12. Intellectual Property
The Service and its content are owned by Fantera or its licensors and protected by law. Fantera grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use. Athletic program names, logos, and marks, and any other third-party names and marks, are the property of their respective owners; their appearance in or on the Service does not imply any affiliation with, sponsorship by, or endorsement by those parties.
13. Third-Party Services
The Service relies on third-party providers (for example, messaging, email, cloud storage, and content-moderation providers) and may link to third-party sites. Fantera does not control and is not responsible for third-party services, which are governed by their own terms and privacy policies.
14. Disclaimers
THE SERVICE, INCLUDING FNR, IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FANTERA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT FNR WILL BE CREDITED FOR ANY PARTICULAR EVENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME MAY NOT APPLY TO YOU.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANTERA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR REWARDS. FANTERA’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID FANTERA IN THE PRIOR TWELVE MONTHS. YOU ACKNOWLEDGE THAT FNR HAS NO CASH VALUE AND THAT ITS LOSS, EXPIRATION, OR CLAWBACK IS NOT RECOVERABLE DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO SOME MAY NOT APPLY TO YOU.
16. Indemnification
You agree to indemnify and hold harmless Fantera and its personnel from claims arising out of your use or misuse of the Service, your violation of these Terms or the law, your content, or your violation of anyone’s rights.
17. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Subject to Section 18, any action not subject to arbitration will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
18. Arbitration and Class-Action Waiver
Please read this section carefully. Before starting formal proceedings, you agree to first contact us at support@fantera.net and try in good faith to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be settled by binding individual arbitration administered by a nationally recognized arbitration provider under its consumer rules. You and Fantera agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class or representative proceeding.
30-day opt out. You may opt out of this arbitration and class-waiver section by emailing support@fantera.net within 30 days of first accepting these Terms, with your name and account identifier and a clear statement that you opt out. Either party may still bring an individual action in small-claims court or seek injunctive relief to protect intellectual property. Any claim must be brought within one year after it arises.
19. Changes to These Terms
Fantera may update these Terms. For material changes, we will update the date above, post a notice in the app, and, where required, obtain your affirmative acceptance. Your continued use after an update constitutes acceptance to the extent permitted by law. If you do not agree to an update, stop using the Service and you may delete your account.
20. Miscellaneous
These Terms and the Privacy Policy are the entire agreement between you and Fantera about the Service. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
